Benjamin Watkins Leigh (1781-1849) nació en Chesterfield County, Virginia, hijo del Reverendo William Leigh (d. 1787) y Elizabeth Watkins (d. 1799). Asistió al Colegio de Guillermo y María, estudió derecho y comenzó a practicar en Petersburgo en 1802. Tras la muerte de ambos padres, actuó como guardián para su hermano menor William. Leigh se casó tres veces: el 24 de diciembre de 1802, con su prima Mary Selden Watkins; el 30 de noviembre de 1813, con Susan Colston; el 24 de noviembre de 1821, con Julia Wickham (1801-1883), la hija mayor de John Wickham. Su hijo Benjamin Watkins Leigh, Jr., (1831-1863) murió en la Batalla de Gettysburg durante la Guerra Civil Americana.
